1. Agreement to Terms

These Terms and Conditions ("Terms") govern your access to and use of the Resonant Structures Media llc website, The Resonant Commons member platform, and all related services, content, and products (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Services.

Resonant Structures Media llc ("RSM," "we," "us," "our") reserves the right to update these Terms at any time. Changes will be posted on this page with a new "Last Updated" date. Your continued use of the Services after changes are posted constitutes acceptance of the revised Terms.

2. Who May Use Our Services

Age Requirement

You must be at least 18 years old to purchase products, create an account, or become a member of The Resonant Commons. If you are under 18, you may use our public content with parental or guardian permission, but you may not make purchases or create an account.

Account Responsibility

If you create an account, you are responsible for:

Maintaining the confidentiality of your login credentials
All activity that occurs under your account
Notifying us immediately at info@bendgilliland.com if you suspect unauthorized access

You may not share your account, transfer your account to another person, or use another person's account without permission.

3. Acceptable Use

You agree to use our Services only for lawful purposes and in accordance with these Terms.

You may not:

Violate any applicable law or regulation
Infringe on the intellectual property, privacy, or other rights of RSM or any third party
Distribute malware, viruses, or harmful code
Attempt to gain unauthorized access to our systems, accounts, or data
Scrape, harvest, or collect user data without permission
Impersonate RSM, our staff, PAL personas, or any other person or entity
Use our Services to harass, threaten, defame, or harm others
Post or transmit spam, deceptive content, or fraudulent material
Interfere with or disrupt the operation of our Services

RSM reserves the right to suspend or terminate access for any user who violates these Terms.

4. Intellectual Property and Content Ownership

RSM Content

All content, materials, and intellectual property on our Services—including but not limited to text, images, logos, videos, audio, graphics, course materials, software, and design—are owned by Resonant Structures Media llc, Ben D. Gilliland, or our licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not:

Copy, reproduce, distribute, publicly display, or create derivative works from our content without written permission
Remove or alter any copyright, trademark, or proprietary notices
Use RSM trademarks, logos, or branding without prior written authorization

Limited License for Personal Use

RSM grants you a limited, non-exclusive, non-transferable license to:

Access and view public content for personal, non-commercial use
Download or stream purchased digital products (eBooks, audiobooks, videos, courses) for your personal use only
Print one copy of purchased materials for personal reference where explicitly permitted

This license does not allow resale, public distribution, reproduction for commercial purposes, or sharing with unauthorized users.

Member and User Content

If you post, upload, or submit content to The Resonant Commons (such as discussion posts, comments, questions, or community contributions), you grant RSM a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute that content in connection with operating and promoting our Services.

You represent and warrant that:

You own or have the necessary rights to any content you submit
Your content does not violate any third-party rights or applicable laws

RSM reserves the right to remove any user content that violates these Terms, is harmful, or is inappropriate.

5. Products and Services

Books (Print, eBook, Audiobook)

Print books are produced on demand and shipped by our printing partner. Shipping times and return policies are described in our Shipping & Returns page.
eBooks and audiobooks purchased through RSM are delivered digitally according to the delivery method stated at purchase.
Retail purchases through Amazon, Apple Books, Barnes & Noble, Audible, or other third-party retailers are governed by those retailers' terms and policies.

The Resonant Commons Membership

Membership provides access to The Resonant Commons digital campus, including:

Member-only content, courses, and resources
Campus departments and PAL-guided services
Ben's Desk and member publications
Community spaces, events, and discussions

Membership Terms:

Monthly billing at $14.95 (or your promotional rate) unless otherwise stated
Automatic renewal each billing period
Cancellation takes effect at the end of the current billing period
No refunds for partial months after the first 7 days or after accessing member content

Membership benefits, features, and pricing are subject to change with notice to active members.

Courses and Digital Products

Internal RSM courses are delivered through The Resonant Commons (Circle platform)
External partner courses are delivered according to the provider's terms, which are disclosed on the product page
Video content is delivered via secure streaming; access terms are provided at purchase
Workbooks and downloadable resources are for personal use only; redistribution is prohibited

Common Market Co-op

The Common Market offers books, courses, wellness products, and curated items. Each product listing states the provider, delivery method, and applicable terms. Purchases are processed through our secure commerce system (WooCommerce/Stripe) or the stated retailer.

6. Pricing, Payment, and Billing

Pricing

All prices are listed in U.S. dollars unless otherwise stated. Prices are subject to change without prior notice, but changes will not affect orders already placed.

Payment

We accept payment via credit card, debit card, and other methods supported by our payment processor (Stripe). By providing payment information, you represent that you are authorized to use that payment method.

Billing for Subscriptions

Memberships are billed monthly on the same day each month
You authorize RSM to charge your payment method automatically each billing period
If a payment fails, we will attempt to notify you and may suspend access until payment is updated
You are responsible for keeping your payment information current

Taxes

Prices do not include applicable sales tax, VAT, or other taxes unless stated. You are responsible for any taxes imposed by your jurisdiction.

Refunds

Refund policies are described in our Shipping & Returns page and vary by product type. In general:

Digital products: Refundable within 7 days if not accessed
Print books: Refundable only if damaged, defective, or incorrect
Memberships: Refundable within 7 days if no member content was accessed

7. PAL Personas and AI-Guided Services

The Resonant Commons features AI-guided staff personas (PALs) such as Charlie, Marian, Dawn, Julie, Gloria, James, Phoenix, Raja, Mr. Jimmy, Mark, and the Ben digital PAL.

PAL interactions and campus services provide general information, guidance, and educational content. They do not constitute:

Medical, mental health, or wellness diagnosis or treatment
Legal, financial, investment, or tax advice

Accuracy and Limitations

While we strive for accuracy, PAL-generated content may contain errors, outdated information, or limitations. You are responsible for:

Verifying important information with qualified professionals
Using your own judgment before acting on any guidance
Not relying solely on PAL interactions for critical decisions

Privacy and Data Use

PAL interactions may be recorded, stored, and used to improve our Services. Your use of PAL services is governed by our Privacy Policy. Do not share sensitive personal information (such as social security numbers, financial account details, or protected health information) in PAL conversations.

Compass and Life Navigator

Compass and Life Navigator are assessment and guidance tools designed to help you evaluate skills, risks, and career pathways.

These tools:

Provide personalized suggestions based on your input
Are educational and exploratory, not diagnostic or prescriptive
Do not guarantee employment, career success, or specific outcomes
Should be used in combination with professional advice and your own research

Assessment data is stored securely and used only as described in our Privacy Policy.

8. Third-Party Services and Links

Our Services may contain links to third-party websites, retailers, course providers, or services (such as Amazon, Apple Books, Audible, Spotify, partner course platforms, wellness vendors).

RSM is not responsible for:

The content, accuracy, or practices of third-party sites or services
Transactions, disputes, or issues occurring on third-party platforms
Privacy practices or terms of third parties

Your use of third-party services is governed by their own terms and policies. We encourage you to review them before use.

9. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the fullest extent permitted by law, RSM disclaims all warranties, including but not limited to:

Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
Warranties that the Services will be uninterrupted, error-free, secure, or virus-free
Warranties regarding the accuracy, reliability, or completeness of content

We do not guarantee:

Specific career, educational, financial, or personal outcomes from using our Services
That our content is suitable for your particular needs or circumstances
Continuous availability of any feature, product, or service

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, RESONANT STRUCTURES MEDIA llc, BEN D. GILLILAND, AND OUR AFFILIATES, EMPLOYEES, AGENTS, AND PARTNERS SHALL NOT BE LIABLE FOR:

Any indirect, incidental, consequential, punitive, or special damages
Loss of profits, revenue, data, or business opportunities
Personal injury or property damage arising from your use of our Services
Errors, omissions, or inaccuracies in content
Unauthorized access to or alteration of your data
Third-party conduct or content

Our total liability to you for any claim arising from these Terms or your use of our Services shall not exceed the amount you paid to RSM in the 12 months prior to the claim, or $100, whichever is greater.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so the above limitations may not apply to you in full.

11. Indemnification

You agree to indemnify, defend, and hold harmless RSM, Ben D. Gilliland, and our affiliates, employees, agents, and partners from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

Your use or misuse of our Services
Your violation of these Terms
Your violation of any third-party rights, including intellectual property, privacy, or other proprietary rights
Any content you submit or post
Your negligence or willful misconduct

12. Termination and Suspension

Your Right to Terminate

You may stop using our Services at any time. You may cancel your membership or delete your account by contacting info@bendgilliland.com or through your account settings.

Our Right to Terminate

RSM reserves the right to suspend or terminate your access to our Services, with or without notice, if:

You violate these Terms
You engage in fraudulent, abusive, or harmful conduct
We are required to do so by law
We cease offering the Services

Upon termination:

Your access to member-only content and services will end
You remain responsible for any outstanding payments
Provisions of these Terms that by their nature should survive (including intellectual property, disclaimers, liability limitations, and dispute resolution) will continue to apply

13. Dispute Resolution and Governing Law

Governing Law

These Terms are governed by the laws of the State of Hawaii and applicable U.S. federal law, without regard to conflict of law principles.

Informal Resolution

If you have a dispute with RSM, please contact us at info@bendgilliland.com to attempt to resolve the matter informally before pursuing formal action.

Binding Arbitration (U.S. Users)

If informal resolution is not successful, you agree that any dispute arising from or relating to these Terms or our Services will be resolved through binding arbitration, rather than in court, except where prohibited by law.

Arbitration terms:

Arbitration will be conducted by the American Arbitration Association (AAA) under its Commercial Arbitration Rules
The arbitration will take place in Hawaii or remotely, at the option of RSM
Each party is responsible for their own costs and attorneys' fees unless the arbitrator awards them
The arbitrator's decision is final and binding, and may be entered as a judgment in any court of competent jurisdiction

Exception: Either party may bring a claim in small claims court if it qualifies.

Class Action Waiver

You agree that any arbitration or legal proceeding will be conducted on an individual basis only, not as a class action, consolidated action, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

International Users

If you are located outside the United States, you agree to resolve disputes in accordance with the laws of Hawaii, but acknowledge that local laws may also apply to your use of our Services.

14. Privacy and Data Protection

Your use of our Services is also governed by our Privacy Policy, which explains how we collect, use, store, and protect your personal information.

By using our Services, you consent to our collection and use of your information as described in the Privacy Policy.

19. Entire Agreement

These Terms, together with our Privacy Policy and Shipping & Returns page, constitute the entire agreement between you and RSM regarding your use of our Services and supersede any prior agreements or understandings.
